1. Premise and use of the Website
The following terms and conditions of use (“Terms and conditions“) apply to the use of the website www.artinresidence.it (“Website”) by its users (“User/Users”).
Pursuant to and for the purposes of art. 7 of Legislative Decree no. 70 of 9.4.2003, Users are provided with the following information: the provider of the services subject to these Terms and Conditions is FARE CULTURA CONTEMPORANEA APPLICATA, with legal address in 20821 Meda (MB), via Trento 68, C.F. and P. IVA 06263060961, REA MB-1906566, e-mail address info@artinresidence.it (“Fare”).
The Website has the purpose of promoting an alternative kind of holiday, i.e., the possibility to experience exceptional cultural, artistic, and architectural contexts and to be accommodated in artists’ residences (“Residences”) while also taking part in cultural experiences organized in the premises of said residences and/or in the local environment (“Services”).
The only function of the Website is the promotion of the above-mentioned Services.
The purchase of Services may only happen by contacting the tour operators/travel agencies that manage the marketing of said Services through the modalities described on the Website. Users shall conclude the travel contract with said tour operators/travel agencies. As a consequence, Users shall acknowledge that Fare is not in any way responsible for any failures in the execution of travel contracts and/or, in general, of the proper, exhaustive and prompt performance of the Services, for Fare is no party to the contract and is no obliged entity to provide services in their favour.
Users agree to use the Website exclusively for legitimate purposes and, in any case, to respect the norms concerning the protection of intellectual property and of personal data, and to indemnify Fare and hold it harmless against all claims and demands deriving from use or abuse of the Services.
Users have the possibility to forward information requests through the Website and – upon giving prior consent – to request e-mail updates about new Residences and/or Services promoted on the Website.
Fare may check on the Users’ respect of these Terms and Conditions at any time, and may also permanently interrupt the delivery of Services to a single User in case he/she:
- has not provided up-to-date, complete, truthful and correct data when registering;
- uses or has used the Services for illegal purposes or in a manner or that Fare deems to be incompatible with the nature of provided Services (such as, but not limited to, the transmission and/or exchange of viruses; the sending or disclosure of personal advertising; chain mail or pyramid schemes; spamming or junk mailing practices; the transmission and/or trade and/or dissemination of illegal or otherwise racist, libelous or defamatory, threatening, vulgar, or obscene material);
- violates, or has violated, these Terms and Conditions, or the terms and conditions applicable to a particular service .
In case the delivery of Services is interrupted in pursuance of the previous paragraph, Fare shall communicate said interruption to its Users via e-mail messages or the publishing of news on the Website.
2. Suspension of Services
Fare reserves the right to temporarily suspend the delivery of Services for the time required for the necessary and/or desirable technical operations aimed at improving its quality. In this case, Users will be given at least 3 days’ prior notice via e-mail and/or the publishing of news on the Website and/or the publishing of dedicated messages in the Services area.
Fare may also terminate Services at any time in case of motivated security reasons or violations of confidentiality (including, but not limited to, the introduction of viruses into the system, and/or blackouts), in this case giving notice – whenever possible – to the Users via general communication on the Website.
Moreover, Fare accepts no responsibility for any damages, claims or losses, direct or indirect, arising in any way from Users for the failure and/or malfunctioning of the Users’ or any third parties’ electronic appliances, or of phone and/or electronic connections when not directly managed by Fare itself or its providers.
3. Links to other websites
The Website may include hyperlinks to other websites operated by third parties, including advertisements and other content providers. These sites may collect data or request personal information from the User. Fare does not exercise, nor is it required to exercise, any form of control on those links, and therefore accepts no liability for damages, claims or losses, direct or indirect, deriving in any form from any User’s view, use and/or operation of third-party websites or services accessed via these links.
4. Changes to Terms and Conditions
Fare reserves the right to modify the Terms and Conditions at any time, for good reasons and/or with the purpose of introducing new favourable conditions for the Users. Said changes shall be promptly notified to the Users via e-mail, or via general notices published on the Website.
Users undertake to print the Terms and Conditions and any other following Changes to them on paper, or on any other suitable durable matter, and to retain such document in their own interest.
5. Copyright and Trademarks
Except for contents subjected to the use of a web crawler, all content of the Website – such as, but not limited to, texts, trademarks, logos, icons, images, illustrations, sounds and videos, databases, source or software codes and licenses – is protected by the law on Intellectual Property (n. 633/41) and is an exclusive property of Fare and/or of the Residences, which manages it upon explicit license and/or authorisation.
Therefore, without prior written consent from Fare – except when just for personal use – it is strictly forbidden to partially or entirely copy, change, publish, publicly promote, transmit, sell, or transfer any material and/or article, image, video, database or programming string taken from the Website.
When accessing the Website, Users accept to comply with the following conditions:
- they accept not to reproduce pages and frames from the Website;
- they accept not to take advantage of the name of the Website and/or of Fare;
- they accept not to reproduce articles, texts, content of links from this Website;
for commercial purposes.
In particular, Users accept that they shall not:
- use the Website in any way that may damage or infringe anyone else’s rights;
- use softwares or programmes that may damage the Website;
- change, alter, or modify the “Look and Feeling” of the Website or its Programmes.
By accepting these Terms and Conditions, Users undertake to indemnify Fare and hold it harmless from any claim, litigation, and request from third parties deriving from, or anyway connected to, the Users’ behaviour with regard to their use of the Website.
6. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Italian law.
For the resolution of any litigation arising from these Terms and Conditions, if the User is a Consumer, the jurisdiction is in the court of his/her city of residence when said residence lies within the borders of the Italian territory
7. Personal Data
The Privacy Policy and Cookie Policy are an integral part of these Terms and Conditions and can be accessed in the Privacy and Cookie Policy Sections of the Website.
